Terms of Service

1. Agreement to Terms
By accessing or using any product or service provided by Nfixa Technologies Ltd. ("Nfixa", "we", "our"), including MySchoolIQ, you agree to be bound by these Terms of Service ("Terms"). If you are registering on behalf of a school or organisation, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use our services.
2. Description of Services
Nfixa develops and operates software-as-a-service (SaaS) platforms for Nigerian educational institutions. Our flagship product, MySchoolIQ, provides school management tools including student records management, attendance tracking, results and reporting, fee management, and a parent communication portal. Services are provided on a subscription basis.
3. Account Registration
To use our services, schools must register through the official application process at myschooliq.com. You are responsible for: • Providing accurate and complete registration information • Maintaining the security of your account credentials • All activities that occur under your account • Promptly notifying us of any unauthorised access at support@nfixa.com We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Subscription & Payment
MySchoolIQ is priced on a per-active-student, per-term basis. Current pricing is communicated to school owners during onboarding and through the platform. Billing is based on the number of active students at the time of each term activation. Nfixa reserves the right to modify pricing with at least 30 days' notice before the change takes effect. Failure to pay subscription fees may result in service suspension.
5. Acceptable Use
You agree not to: • Use our services for any unlawful purpose or in violation of Nigerian law • Upload or transmit malicious code, viruses, or harmful content • Attempt to gain unauthorised access to our systems or other users' accounts • Scrape, copy, or redistribute our platform without permission • Use our platform to harass, abuse, or harm any individual • Misrepresent student or school data • Share login credentials with unauthorised persons Violation of these restrictions may result in immediate account termination without refund.
6. Data & Privacy
You retain ownership of all data you input into our platforms. By using our services, you grant Nfixa a limited licence to process your data solely for the purpose of providing the services. We act as a data processor on your behalf and you, as the school, act as the data controller for student and guardian data. Both parties agree to comply with the Nigeria Data Protection Act (NDPA) 2023. Our full Privacy Policy is available at nfixa.com/legal/privacy.
7. Intellectual Property
All software, designs, trademarks, logos, and content created by Nfixa are the exclusive intellectual property of Nfixa Technologies Ltd. and are protected by Nigerian and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of our products without written permission. You retain full ownership of all content and data you create using our platform.
8. Service Availability
We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime from time to time. We will endeavour to notify users of planned maintenance. Nfixa is not liable for any losses resulting from temporary service unavailability.
9. Limitation of Liability
To the maximum extent permitted by Nigerian law, Nfixa Technologies Ltd., its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of data, revenue, or profits. Our total liability for any claim shall not exceed the amount paid by you in the 3 months preceding the claim. Nothing in these Terms limits liability for fraud, gross negligence, or death or personal injury caused by our negligence.
10. Indemnification
You agree to indemnify and hold harmless Nfixa Technologies Ltd. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.
11. Termination
Either party may terminate the service agreement with 30 days written notice. Nfixa may terminate immediately for material breach of these Terms. Upon termination, your access to the platform will be suspended. We will make your data available for export for 60 days following termination, after which it may be deleted. Provisions relating to intellectual property, limitation of liability, and governing law survive termination.
12. Governing Law & Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration in Abuja, FCT, Nigeria, in accordance with the Arbitration and Conciliation Act. Nothing prevents either party from seeking urgent injunctive relief from a Nigerian court.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
